Strideful Inc. Mobile App Terms of Service

Welcome to Strideful, an app designed to support your mental and physical well-being through structured activity plans. By using our services, you agree to these Terms of Service (“Terms”). Please read them carefully.

  1. Acceptance of Terms By downloading, accessing, or using the Strideful app (“App”), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
  2. Health and Warranty Disclaimer
  • Risk Acknowledgment: Participating in physical activities such as those suggested by Strideful carries inherent risks, including the risk of injury. It is strongly recommended that you consult with a healthcare provider before beginning any new exercise program, especially if you have any pre-existing health conditions or concerns.
  • Non-Substitution: The information provided by Strideful is for general informational purposes only and is not intended to replace professional medical advice, diagnosis, or treatment. You should not rely solely on the information provided in the App to make health decisions.
  • No Warranties: While we are proud of our work, we cannot guarantee any health results or benefits, whether mental or physical, from your use of the App. TO THE EXTENT ALLOWED BY APPLICABLE LAW, THE APP IS OFFERED AND PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  1. Service Description Strideful offers generalized walking and running plans designed to enhance mental and physical wellness. These plans are not personalized medical advice, nor do they constitute personal coaching services. The App is intended to supplement, not replace, guidance from healthcare professionals.
  2. User Accounts To access certain features of the App, you may need to create and maintain an active personal user account. You are solely responsible for safeguarding your account credentials and for all activities conducted under your account. Strideful reserves the right to terminate or suspend accounts for any violation of these Terms.
  3. Use of the App
  • Age Requirement: You must be at least eighteen (18) years of age to use the App.
  • User Content: You may have the opportunity to submit content, such as feedback, testimonials, or personal success stories (“User Content”). By submitting User Content, you grant Strideful a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.
  • Prohibited Uses: You agree not to use the App for any illegal activities, to infringe upon the rights of others, or to interfere with or disrupt the App’s functionality. You are also prohibited from engaging in any activity that could harm the App or its users. Strideful reserves the right to monitor and censor User Content for any violation of these Terms.
  1. Intellectual Property All rights, title, and interest in and to the App, including all content, features, and functionality (including but not limited to software, text, graphics, logos, and icons), are owned by Strideful Inc. or its licensors. You may not copy, modify, distribute, sell, or lease any part of the App unless you have explicit written permission from Strideful.
  2. Liability Waiver By using the App, you voluntarily assume all risks associated with physical activity and agree to release and hold harmless Strideful Inc. and its affiliates, officers, directors, employees, and agents from any claims, liabilities, or expenses (including reasonable attorneys’ fees) arising from or related to your use of the App, including but not limited to injuries or damages incurred during physical activities.
  3. Indemnification You agree to indemnify, defend, and hold Strideful Inc. and its affiliates, officers, directors, employees, and agents harmless from any and all claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from or related to your use of the App, your violation of these Terms, or your infringement of any third-party rights.
  4. Modifications to the Service and Terms Strideful reserves the right to modify or discontinue the App, or to update these Terms at any time. Any significant changes to these Terms will be communicated to you through the App or by other reasonable means. Your continued use of the App after any such changes constitutes your acceptance of the revised Terms.
  5. Governing Law and Mandatory Binding Arbitration. These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.  Any legal action or proceeding arising under these Terms shall be resolved in arbitration before a single arbitrator within Erie County, New York, in accordance with the Consumer Arbitration Rules of the American Arbitration Association. The prevailing party of any such arbitration, as determined by the arbitrator, shall be awarded all of its costs and expenses, including its reasonable attorneys’ fees, in connection with the arbitration.
